Terms of Use — Employers

1. Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you, the organization you represent ("Employer," "Company," "Organization," or "you"), and Bricks Marketing L.L.C ("Watheef," "Platform Provider," "we," "us," or "our"), a limited liability company organized and existing under the laws of the State of Wyoming, United States of America, with its registered agent located at 1712 Pioneer Ave, Suite 500, Cheyenne, Wyoming 82001.
By creating an employer account, establishing an organization, or using any employer-facing features on watheef.com (the "Platform"), you represent that you are authorized to bind your organization to these Terms and that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any applicable Service Level Agreements or subscription terms.
2. Eligibility
To use the Platform as an Employer, you must: (a) be a legally registered business entity or authorized representative thereof; (b) be located in or conducting business in the State of Kuwait; (c) have a valid commercial license or equivalent business authorization; (d) designate at least one authorized individual ("Account Owner") who is at least 18 years of age and has the legal authority to bind the organization; (e) provide accurate and complete organizational information during registration.
Watheef reserves the right to request verification of your business registration, commercial license, or other documentation to confirm your eligibility as an Employer on the Platform.
3. Organization Account
3.1. Upon registration, you will create an Organization with a unique identifier ("Organization Slug") that forms part of your Platform URL. You are responsible for selecting an appropriate Organization Slug that does not infringe upon the trademarks or intellectual property rights of third parties.
3.2. The Account Owner may invite team members to the Organization with designated roles (Admin, Recruiter, or Viewer). The Account Owner is responsible for the actions of all team members and must ensure that each team member agrees to and complies with these Terms.
3.3. You are solely responsible for managing access to your Organization account, including revoking access for former employees or unauthorized individuals. Watheef shall not be liable for any unauthorized access resulting from your failure to manage team member access.
4. Subscription Plans and Modules
4.1. Watheef offers tiered subscription plans (Free, Basic, Pro, and Enterprise), each providing access to different modules and features. The specific features, limitations, and pricing of each plan are described on the Platform's pricing page and may be updated from time to time.
4.2. Certain features operate on a modular basis, meaning they can be independently enabled or disabled based on your subscription plan. Modules include but are not limited to: Job Posting, Hiring Pipeline, Candidate Browse, Reveal Credits, AI Tools, Integrations, and Analytics.
4.3. Free Plan: The Free plan allows a limited number of job postings and team members. Free plan users are subject to feature restrictions as described on the pricing page. Watheef reserves the right to modify or discontinue the Free plan at any time.
4.4. Paid Plans: Paid subscriptions are billed on a monthly or annual basis as selected during purchase. All fees are quoted in Kuwaiti Dinar (KWD) unless otherwise specified. Fees are non-refundable except as required by applicable law or as otherwise stated in these Terms.
4.5. Reveal Credits: Certain plans include a limited number of credits that allow you to reveal candidate contact information. Credits are consumed upon reveal and cannot be restored. Unused credits do not carry over between billing periods unless otherwise specified in your plan.
4.6. Watheef reserves the right to modify pricing, features, and plan structures with thirty (30) days' advance notice. Continued use of the Platform after price changes take effect constitutes acceptance of the new pricing.
5. Job Postings
5.1. You may create and publish job postings ("Job Posts") on the Platform subject to the limitations of your subscription plan. Each Job Post must accurately describe the position, requirements, compensation (if disclosed), and working conditions.
5.2. You represent and warrant that all Job Posts: (a) describe genuine, lawful employment opportunities; (b) comply with all applicable labor laws, including but not limited to Kuwait Labor Law No. 6 of 2010 and its amendments; (c) do not discriminate on the basis of race, religion, gender, age, disability, or any other protected characteristic except where a bona fide occupational qualification exists and is permitted by law; (d) do not require applicants to pay fees for the opportunity to apply or be considered; (e) accurately represent the compensation, benefits, and working conditions of the position.
5.3. Job Posts have a maximum active duration of thirty (30) days, after which they will automatically close. You may manually close a Job Post at any time. Closed posts can be reopened subject to your plan limits.
5.4. Watheef reserves the right to remove, edit, or refuse to publish any Job Post that violates these Terms, applicable law, or our content guidelines, at our sole discretion and without prior notice or refund.
6. Candidate Data and Privacy
6.1. When candidates apply to your Job Posts, you will receive access to their application data, including profile information, CV, answers to custom questions, and referral source. You agree to treat all candidate data as confidential and handle it in accordance with applicable data protection laws.
6.2. You agree that you will: (a) use candidate data solely for the purpose of evaluating candidates for the specific position(s) for which they applied; (b) not sell, rent, lease, or otherwise commercially exploit candidate data; (c) not share candidate data with third parties without the candidate's explicit consent, except as necessary for the hiring process (e.g., sharing with internal hiring managers); (d) implement appropriate technical and organizational measures to protect candidate data from unauthorized access, loss, or destruction; (e) delete candidate data upon request from the candidate or Watheef.
6.3. You acknowledge that Watheef may restrict access to certain candidate information (such as contact details) behind a credit-based reveal system. You agree not to attempt to circumvent these restrictions through any means.
6.4. If you process candidate data subject to the General Data Protection Regulation (GDPR) or similar regulations, you acknowledge that you act as a data controller for such data and are independently responsible for compliance with applicable data protection obligations.
7. Hiring Pipeline and Communications
7.1. The Platform provides tools for managing your hiring pipeline, including stage tracking, candidate notes, and status updates. Notes and internal communications added to the Platform are visible only to your Organization's team members and are not shared with candidates unless you choose to send a notification.
7.2. When you move a candidate between pipeline stages, you may configure the Platform to automatically notify the candidate via email. You are responsible for the content and timing of such notifications. Watheef provides default email templates that you may customize. You agree that all communications sent through the Platform comply with applicable anti-spam laws and are professional in nature.
7.3. You agree to respond to candidates within a reasonable timeframe. While Watheef does not mandate response times, prolonged unresponsiveness may result in warnings or restrictions on your account.
8. Careers Page
8.1. Watheef provides an optional public Careers Page for your Organization, accessible at watheef.com/{your-slug}/careers. You may enable or disable this page through your Organization settings.
8.2. The Careers Page displays your Organization's name, description, industry, and active Job Posts. You are responsible for ensuring all information displayed is accurate and up to date.
8.3. By enabling the Careers Page, you grant Watheef permission to publicly display your Organization information and Job Posts for the purpose of attracting candidates.
9. Prohibited Conduct
You agree not to: (a) post fraudulent, deceptive, or misleading job listings; (b) use the Platform for any purpose other than legitimate recruitment; (c) charge candidates any fee for applying to jobs or for any part of the hiring process; (d) collect candidate data for purposes unrelated to recruitment, including marketing, data aggregation, or resale; (e) use automated tools to scrape or extract candidate data from the Platform; (f) discriminate against candidates in violation of applicable law; (g) harass, threaten, or otherwise mistreat candidates; (h) attempt to circumvent the Platform's access controls, credit systems, or security measures; (i) misrepresent your Organization's identity, size, location, or nature of business; (j) use the Platform to recruit for positions involving illegal activities; (k) interfere with the Platform's operations or infrastructure.
10. Intellectual Property
10.1. The Platform, including its design, features, functionality, content, and all intellectual property rights therein, are owned by Bricks Marketing L.L.C You may not reproduce, modify, distribute, or create derivative works of any part of the Platform without prior written consent.
10.2. You grant Watheef a non-exclusive, worldwide, royalty-free license to use your Organization's name, logo, and branding materials solely for the purpose of operating the Platform and displaying your Careers Page and Job Posts.
10.3. You retain ownership of all content you create on the Platform, including Job Posts, custom questions, email templates, and Organization descriptions. However, Watheef may use aggregated, anonymized data derived from your use of the Platform for analytics, benchmarking, and improvement purposes.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WATHEEF DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WATHEEF DOES NOT WARRANT THE QUALITY, ACCURACY, OR SUITABILITY OF ANY CANDIDATES ON THE PLATFORM. WATHEEF DOES NOT GUARANTEE THAT YOU WILL SUCCESSFULLY FILL ANY POSITION THROUGH THE PLATFORM. ALL HIRING DECISIONS ARE MADE SOLELY BY YOU, AND WATHEEF BEARS NO RESPONSIBILITY FOR THE OUTCOME OF ANY HIRING PROCESS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATHEEF'S TOTAL LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO WATHEEF IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WATHEEF BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to indemnify, defend, and hold harmless Watheef and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses arising out of: (a) your use of the Platform; (b) your Job Posts or hiring practices; (c) your violation of these Terms or applicable law; (d) your handling of candidate data; (e) any disputes between you and candidates; (f) any claim by a third party relating to your Organization's use of the Platform.
14. Governing Law and Dispute Resolution
14.1. These Terms shall be governed by applicable law. Any dispute shall first be submitted to good faith negotiation for thirty (30) days, followed by binding arbitration.
14.2. For Employers located in the State of Kuwait, disputes relating to local employment law matters shall be subject to the jurisdiction of the Kuwaiti courts to the extent required by mandatory local law.
15. Modifications, Termination, and General Provisions
15.1. Watheef may modify these Terms with thirty (30) days' notice. Continued use constitutes acceptance.
15.2. Either party may terminate the relationship at any time. Upon termination, your access to the Platform will cease, and active Job Posts will be closed. Watheef may retain data as required by law.
15.3. These Terms constitute the entire agreement between the parties. If any provision is found invalid, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver of that provision.
