Terms of Use — Job Seekers

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("Job Seeker," "Candidate," or "you") and Bricks Marketing L.L.C ("Watheef," "Company," "we," "us," or "our").

By creating an account on watheef.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules applicable to specific services or features that may be posted on the Platform from time to time. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

To use the Platform as a Job Seeker, you must: (a) be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater; (b) have the legal capacity to enter into a binding agreement; (c) not be prohibited from using the Platform under applicable law; (d) provide accurate, truthful, and complete information during registration and at all times thereafter.

If you are using the Platform from outside the State of Kuwait, you are solely responsible for ensuring compliance with all local, national, and international laws and regulations applicable to your use of the Platform, including but not limited to immigration, employment, data protection, and privacy laws.

3. Account Registration and Security

3.1. You must provide a valid email address and verify it through our one-time password (OTP) verification process during registration. If you are located in Kuwait or a Gulf Cooperation Council (GCC) country, you must also provide and verify a valid mobile phone number.

3.2. You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify Watheef of any unauthorized use of your account or any other breach of security. Watheef shall not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3. You may not create multiple accounts, share your account with any other person, or transfer your account to any third party without prior written consent from Watheef.

3.4. Watheef reserves the right to suspend, deactivate, or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or extended period of inactivity.

4. Profile and Content

4.1. You are solely responsible for the accuracy, completeness, and truthfulness of all information you provide on the Platform, including but not limited to your name, contact information, work experience, education, skills, certifications, nationality, visa status, and any other profile data ("Profile Information").

4.2. By submitting Profile Information, you represent and warrant that: (a) all information is accurate and not misleading; (b) you have the right to provide such information; (c) the information does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party; (d) the information does not contain any unlawful, defamatory, obscene, or otherwise objectionable content.

4.3. You grant Watheef a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your Profile Information solely for the purposes of operating the Platform, facilitating job matching, and providing services to employers.

4.4. You understand and agree that your Profile Information may be visible to employers and recruiters on the Platform, subject to the Platform's privacy settings and access controls. Certain information, including contact details, may be restricted and only disclosed to employers under specific conditions (such as credit-based reveal systems).

4.5. Watheef reserves the right to remove, edit, or refuse to display any content that violates these Terms or that we deem inappropriate, misleading, or harmful, at our sole discretion and without prior notice.

5. CV and Document Upload

5.1. You may upload your curriculum vitae (CV), resume, cover letters, certificates, and other supporting documents ("Documents") to the Platform. You represent and warrant that all Documents are genuine, accurate, and belong to you.

5.2. Documents may be stored using third-party cloud storage services (including Amazon Web Services). While Watheef takes reasonable measures to protect your Documents, we do not guarantee absolute security and shall not be liable for any unauthorized access, loss, or corruption of Documents.

5.3. You may delete your Documents at any time through your account settings. Upon account termination, Watheef will delete your Documents within a reasonable period, subject to any legal retention obligations.

6. Job Applications

6.1. When you apply to a job posting on the Platform, your application, Profile Information, and any Documents you submit will be shared with the employer who posted the job. You consent to this disclosure.

6.2. Watheef acts solely as an intermediary platform connecting Job Seekers with employers. Watheef does not guarantee employment, does not endorse any employer, does not verify the accuracy of job postings, and is not a party to any employment contract or arrangement between you and any employer.

6.3. You acknowledge that employers make their own hiring decisions independently of Watheef, and Watheef shall not be liable for any decision made by an employer regarding your application, including rejection, discrimination, or any other adverse action.

6.4. You agree not to submit false, misleading, or fraudulent applications. Watheef reserves the right to remove applications and suspend accounts engaged in such activities.

7. Communication and Notifications

7.1. By creating an account, you consent to receive communications from Watheef via email and, where applicable, SMS. These communications may include account verification codes, application updates, status changes, interview invitations, and platform announcements.

7.2. You may opt out of non-essential communications at any time through your account settings. However, you may not opt out of transactional communications necessary for account operation, security, and legal compliance.

8. Prohibited Conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) impersonate any person or entity; (c) submit false, misleading, or fraudulent information; (d) harass, threaten, or abuse any user, employer, or Watheef personnel; (e) attempt to gain unauthorized access to the Platform, other user accounts, or any systems connected to the Platform; (f) use automated tools, bots, scrapers, or crawlers to access or interact with the Platform; (g) interfere with or disrupt the Platform's infrastructure; (h) upload malware, viruses, or any malicious code; (i) use the Platform to collect personal information of other users without their consent; (j) circumvent any security measures or access restrictions; (k) post or transmit spam, chain letters, or unsolicited messages; (l) engage in any activity that could damage, disable, or impair the Platform.

9. Intellectual Property

9.1. The Platform, including its design, features, functionality, content, trademarks, logos, and all intellectual property rights therein, are owned by Bricks Marketing L.L.C and are protected by applicable intellectual property laws.

9.2. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Platform without prior written consent from Watheef.

9.3. "Watheef" and the Watheef logo are trademarks of Bricks Marketing L.L.C You may not use these trademarks without our express written permission.

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy. Watheef complies with applicable data protection regulations, including but not limited to the General Data Protection Regulation (GDPR) where applicable and Kuwait's data protection laws.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WATHEEF SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WATHEEF DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WATHEEF DOES NOT GUARANTEE THAT YOU WILL RECEIVE ANY JOB OFFERS OR EMPLOYMENT THROUGH THE PLATFORM.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WATHEEF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WATHEEF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WATHEEF'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO WATHEEF, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Watheef and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content or information you submit through the Platform; (e) your interactions with employers or other users of the Platform.

14. Governing Law and Dispute Resolution

14.1. These Terms shall be governed by and construed in accordance with applicable law.

14.2. Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration.

14.3. Notwithstanding the foregoing, Watheef reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

15. Modifications to Terms

Watheef reserves the right to modify, amend, or update these Terms at any time at its sole discretion. When we make material changes, we will notify you by email or through a prominent notice on the Platform prior to the changes taking effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must discontinue your use of the Platform and delete your account.

16. Termination

16.1. You may terminate your account at any time by contacting Watheef support or through your account settings.

16.2. Upon termination, your right to access the Platform will immediately cease. Watheef may retain certain information as required by law or for legitimate business purposes, including dispute resolution, enforcement of these Terms, and fraud prevention.

16.3. Sections 9, 11, 12, 13, 14, and this Section 16 shall survive termination of these Terms.

17. General Provisions

17.1. Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Watheef regarding the Platform and supersede all prior agreements and understandings.

17.2. Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3. Waiver. The failure of Watheef to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4. Assignment. You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Watheef. Watheef may assign its rights and obligations without restriction.

17.5. Force Majeure. Watheef shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, internet outages, or power failures.
